改裝潢增加衛浴用水量 卻沒有做排水工程

想請問

朋友的房子 一樓是親戚在住且是有在開店做生意
朋友是住2 3 4 5樓 是做套房出租的生意

此房屋是將近50年的房齡 在他爺爺時代 樓下依然做生意 但是樓上是雅房出租

他爺爺過世後~
樓上將雅房做成了十幾間套房 每間套房都有自己的衛浴設備
可是 卻沒有改做排水系統 以應付增加的排水量 依然沿用舊排水系統

導致 樓上樓下 常因為污水滲出的問題一直吵架

問朋友之下 才知道 原來當初樓上朋友的父親不願做排水系統的原因
是因為 不想便宜到樓下的親戚

而樓下 也收集了很多污水滲出照片 與排水管外觀照片 一口咬定都是樓上害的

這樣子 樓上是否違規??? 這棟樓會變成危樓嗎???
